Important Read Carefully: This End User License Agreement is a legal agreement between you (either an individual or a single entity) and JobSniper (JobSniper) for the JobSniper Software accompanying this End User License Agreement, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation and information ("software product" and "software"). By exercising your rights to use the software product and/or by accessing the online related information and documentation, you agree to be bound by the terms of this End User License Agreement. If you do not agree to the terms of this End User License Agreement, you may not use the software product.
SOFTWARE PRODUCT LICENSE.
Software product is protected by copyright laws as well as other intellectual property laws and treaties. Software product is licensed, not sold.
Grant of license.
This End User License Agreement grants you the following rights: installation and use. You may install and use the software product and obtain online access to the related information and documentation.
Reproduction and distribution.
You may not reproduce and distribute the software product.
Description of other rights and limitations.
Limitations on reverse engineering, decompilation, and disassembly. You may not reverse engineer, decompile, or disassemble the software product, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding its limitation. JobSniper reserves the right to choose advertising and strategic partners and to promote the goods and services of those partners in a manner consistent with state and federal law. In this process names and identities used for the express purpose of advertising and promotion may not represent actual persons. JobSniper makes no warranties regarding the advertised goods or services of third parties who may be advertised or promoted at JobSniper.com.
Separation of components.
The software product is licensed as a single product. Its component parts, information, and services may not be separated for use on more than one computer.
Software transfer.
You may not transfer, sell, give, or assign any of your rights under this End User License Agreement.
Termination.
Without prejudice to any other rights, JobSniper may terminate this End User License Agreement if you fail to comply with the terms and conditions of this End User License Agreement. In such event, you must destroy all copies of the software product and all of its component parts in your possession and abstain from further online access.
Copyright.
All title and copyrights in and to the software product (including but not limited to any documentation, images, photographs, animations, video, audio, music, text, and "applets" incorporated into the software product), the accompanying printed materials, and any copies of the software product are owned by JobSniper or its suppliers. Software product is protected by copyright laws; therefore you must treat the software product like any other copyrighted material.
NO WARRANTY
No warranties.
JobSniper expressly disclaims any warranty for the software product. Software product, including online access, and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The entire risk arising out of use or performance of the software product remains with you.
LIMITATION OF LIABILITY.
JobSniper' entire liability and your exclusive remedy under this End User License Agreement shall not exceed five dollars ($5.00).
NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
In no event shall JobSniper or its suppliers, advertisers, or clients be liable for any damages whatsoever (including, without limitation, damages for lost business opportunity, loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this JobSniper Software Product, even if JobSniper has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
MISCELLANEOUS.
If you acquired this product in the United States, this End User License Agreement is governed by the laws of the state of Arizona.
If this product was acquired outside the United States then local laws may apply.
